You are welcome to register for a Shipfinder Platform account and utilize the services of the Shipfinder Platform!

The Shipfinder platform is a registered trademark of ELANE TECHNOLOGY CO., LIMITED in Hong Kong.

Shipfinder is a comprehensive shipping big data product platform operated by Shipfinder. We would like to remind you to read this User Agreement (hereinafter referred to as the "Agreement") and Shipfinder Privacy Policy carefully before registering as a user, especially the rules and regulations highlighted in bold, which may involve the exclusion or limitation of liability of the relevant parties, the application of laws and dispute resolution. Shipfinder recommends that you read them carefully.

1. Confirmation of service agreements

1.1 The parties to this Agreement are ELANE TECHNOLOGY CO., LIMITED, the operator of the Shipfinder Platform, and the user of the Shipfinder Platform Services (referred to in this Agreement as "You" or "User"), and this Agreement is a formal written contract between You and the Shipfinder Platform relating to Your registration of an account on the Shipfinder Platform and Your use of the Shipfinder Platform Services. (referred to in this Agreement as "you" or "user"), this Agreement is a formal written contract between you and the Shipfinder Platform relating to your registration of an account on the Shipfinder Platform and your use of the Shipfinder Platform Services.

1.2 This Agreement includes the body of this Agreement and all specific terms of service, supplemental agreements, and rules and regulations that have been or will be issued by the Shipfinder Platform. All specific terms of service, supplemental agreements and rules are an integral part of this Agreement and have the same legal effect as the main text of the Agreement. Once the above content is officially released, it is an inseparable part of this Agreement, and you should also comply with it.

1.3 The Shipfinder Platform will provide you with the Services in accordance with the terms of this Agreement and the relevant operating rules, and you must agree to all of the terms of this Agreement in order to register for an account on the Shipfinder Platform or to use all of the Shipfinder Platform's Services. If you do not agree with any of the contents of this Agreement, you should stop registering or using it immediately. By clicking "Agree" during the registration process, you indicate that you are fully aware of and accept this Agreement, and voluntarily accept the constraints of all the contents of this Agreement. 2. Account Registration

2.1 When you apply to register for the Service, the Shipfinder Platform needs to collect your cell phone number and location information in order to provide users with a better experience. For details, please refer to the Shipfinder Privacy Policy.

2.2 If there is any change in your subject information, it is recommended that you update it in order to facilitate business cooperation. Any loss to the parties to the agreement or to a third party due to the authenticity of the information provided by you shall be borne by you.

3. Services

3.1 The Shipfinder platform provides ship location, ship files, port files, chart information, value-added services for shipping data, and so on.

3.2 The specific content of the Services is provided by the Shipfinder Platform on an as-is basis. the Shipfinder Platform may make changes to the Services it provides, and the content of the Services provided by the Shipfinder Platform may change at any time, and Users will receive notice of changes to the Services from the Shipfinder Platform.

4. Protection of privacy

4.1 We recognize the importance of your personal information and will do our best to protect your personal information safely and securely. We are committed to maintaining your trust in us and abide by the following principles to protect your personal information: the principle of consistency of authority and responsibility, the principle of clarity of purpose, the principle of opt-in consent, the principle of minimum sufficiency, the principle of ensuring security, the principle of subject participation, the principle of openness and transparency, and so on. At the same time, we promise that we will take appropriate security measures to protect your personal information in accordance with the industry's mature security standards. 5. Rules of use

5.1 Any Content generated by You in or through the Service does not reflect or represent, and shall not be deemed to reflect or represent, the views, positions or policies of the Shipfinder Platform, for which the Shipfinder Platform is not responsible.

5.2 You shall be solely responsible for the truthfulness, legality, harmlessness, accuracy and validity of the information or operational behavior transmitted using our account or the Service, and you shall bear all legal liabilities related to the information or operational behavior transmitted by you, independent of the Shipfinder Platform. If any damage is caused to the Shipfinder Platform or a third party, you shall be compensated in accordance with the law.

5.3 In using the Service, you must comply with the following principles.

5.4 You understand and agree that Shipfinder provides you with a non-transferable, revocable, and non-exclusive service, and that unless otherwise agreed in writing, you may use our products and services for non-commercial purposes only, and you may not sell or otherwise make available to third parties for profit the service information that you obtain when you use Shipfinder's services, or the services themselves, and you may not use the data and service information provided by Shipfinder to engage in any behavior that violates laws, regulations or other regulatory policies.

5.5 The services provided by the Shipfinder Platform may include advertisements, and you agree to the display of advertisements provided by the Shipfinder Platform and third-party vendors and partners in the course of use. Except as expressly provided by laws and regulations, Users shall be solely responsible for the transactions conducted on the basis of such advertisements, and the Shipfinder Platform shall not be liable for any losses or damages suffered by Users as a result of the transactions conducted on the basis of such advertisements or the content provided by the aforesaid advertisers.

6. Account management

6.1 Upon successful registration of your account, you will be able to log in to the Shipfinder Platform with your account number and use the services of the Shipfinder Platform as required. If you have not completed the registration process, the Shipfinder Platform still allows you to access the Shipfinder Platform and use limited services, such as vessel location search. If you have completed the registration process in its entirety but have not logged in to use the Services, you will only be able to use the Limited Services.

6.2 Your account is owned by the Shipfinder Platform, and by completing the registration process, you acquire the right to use our account, which belongs only to the person who initially applied for registration.

6.3 You have the right to change or delete your personal data, registration information and transmissions in the Service, but the deletion of such information will also delete any text and images that you have stored in the system.

6.4 When you log in to your Shipfinder Platform account to use the Shipfinder Platform Services, you shall not engage in unintentional continuous and frequent querying operations, or unreasonably and massively access Shipfinder Platform's information, data and information through machine capture, copying, mirroring, etc. Otherwise, Shipfinder Platform has the right to block your account without any responsibility. In the event that multiple accounts within the same IP address engage in the above behavior multiple times, the Shipfinder Platform will have the right to automatically block the IP address without any responsibility to you.

6.5 In order to ensure the security of the relevant account, without the written consent of Shipfinder, you shall not transfer, sell, rent, lend or share your account to others for use. Otherwise, if your account violates or may violate the legitimate rights and interests of Shipfinder or a third party, you shall bear the relevant compensation responsibility, and Shipfinder has the right to restrict, freeze or cancel your account without notice without any responsibility. Shipfinder Platform has the right to restrict, freeze, cancel your account, suspend or terminate the provision of some or all of the services under this Agreement without notice and without any liability, and Shipfinder Platform will determine whether your account has been used in violation of the foregoing based on certain criteria, such as whether the number of devices logged in and used by the same account is abnormal, whether the number of inquiries made by the same account in a single day is abnormal, and whether other specific behaviors are sufficient for Shipfinder Platform to recognize as violation of use. Shipfinder will use certain criteria to determine whether your account has been used in violation of the above conditions.

6.6 You are legally responsible for the security of your registered account and for all activities and events carried out under your account (including, but not limited to, signing any agreement online, uploading, posting and inputting any content), and all acts occurring through your account will be deemed to be the true expression of your own will. You should properly and correctly store, use and maintain your account and password, and take necessary and effective measures to protect the confidentiality of your account and password. Otherwise, Shipfinder shall not be liable for any loss or damage caused by the leakage or loss of your account, password, or other valid identifying information, or the theft or alteration of your account and password due to your personal reasons. If you accidentally lose your password, you can retrieve it by obtaining a verification code through your registered or bound cell phone number and performing a password reset. If you become aware of any unauthorized use of your account or password or any breach of security of your account, please notify the Shipfinder Platform immediately. You understand that it takes a reasonable amount of time for the Shipfinder Platform to act on your request, and that the Shipfinder Platform will not be liable for the consequences (including, without limitation, any damages to you) that may have occurred prior to the time that it takes to act on your request.

6.7 The Shipfinder Platform provides you with the ability to cancel your account. You can apply to cancel your account in the following ways:

After cancellation of your account, we will stop providing you with products or services and, at your request, delete your personal information or anonymize your personal information, unless otherwise provided by law or regulation.

6.8 If you violate any of the terms of this Agreement, we have the right to restrict, freeze, cancel your account, suspend or terminate the provision of some or all of the Services to you under this Agreement without notice and without any liability for such violation. Upon cessation or termination of the Service, Shipfinder Platform deletes or anonymizes Users' personal information.

7. Intellectual property rights

7.1 Unless otherwise specifically stated, all intellectual property rights (including, without limitation, copyrights, trademarks, patents, trade secrets) and other related rights in and to all Shipfinder Platform products, technology, software, programs, data and other information (including, without limitation, data, text, images, charts, audio, video, color, layout, and electronic files) are owned by the Shipfinder Platform. Without the written authorization of the Shipfinder Platform, no one is allowed to reverse engineer, decompile or disassemble the software, capture, reproduce, duplicate, publish, distribute, publicly display, encode, translate, transmit, disseminate, or mirror the data, information, and materials of the Shipfinder Platform, or to obtain the data of the Shipfinder Platform automatically by other software programs. Shipfinder Platform shall not provide the acquired information and data to any third party for use, otherwise, Shipfinder Platform will pursue your legal responsibility according to the law.

7.2 You understand and agree that any content (including, but not limited to, images, photographs, animations, video recordings, audio recordings, music, text, etc.) uploaded, posted, transmitted or disseminated by you through the Shipfinder Platform to the Shipfinder Platform which is publicly available on the Shipfinder Platform was originally created or legally licensed to you, and that your uploading, submitting, storing or posting will not infringe on the intellectual property rights or other legal rights of others. Otherwise, Shipfinder Platform has the right to delete or take other necessary measures to stop (including but not limited to blocking and/or terminating the use of your account); at the same time, you authorize Shipfinder Platform to grant Shipfinder Platform a free, perpetual, irrevocable, non-exclusive, worldwide license to use and distribute the publicly available content that you have uploaded to Shipfinder Platform, free of charge. You grant the Shipfinder Platform a worldwide, free, perpetual, irrevocable, non-exclusive right to use and fully sublicense such content, in whole or in part, to use, reproduce, modify, adapt, publish, translate, create derivative works based on, transmit, perform, and display such content, or to incorporate such content into any other form of work, media, or technology now known or later developed.

7.3 In order to continuously improve and provide better services to Users, if You are a Business User, You agree that the Shipfinder Platform may use Your name, font size, trademark, and other information or logos in the Shipfinder Platform family of products as well as in events and/or other publicity and promotions organized by the Shipfinder Platform.

7.4 If you believe that the Shipfinder Platform or content on the Shipfinder Platform has unduly affected your intellectual property rights, you may submit materials to defend your rights through the Shipfinder Platform's customer service, and the Shipfinder Platform will judge the reasonableness and legitimacy of your request and materials and provide timely feedback.

7.5 Shipfinder can not grow without your support and help, thank you very much for providing us with data updates, intelligence feedback and various ship pictures and content contributions. You can use Shipfinder to report errors in ship position locations, add new annotations, report errors in ship information data, share ship pictures, etc. to help more users enjoy more accurate information. When you share any information publicly in Shipfinder's products or services, anyone may view or access such information when using or not using Shipfinder's products or services, such as photos you uploaded in Shipfinder and data you provided such as vessel location, Chinese vessel name, etc. Please remove relevant personal information and make careful decisions when you share the information, once these shared data passes Shipfinder's review, the data will be provided and shared with Shipfinder and will be held, controlled and processed by Shipfinder in accordance with Shipfinder's business rules.

8. Protection of minors

8.1 Our products, websites and services are intended only for adults who are at least 18 years of age and have full civil capacity. We do not actively collect personal information directly from minors. If it is proven that a minor has registered for a product or service without the consent of a guardian, we will endeavor to delete the personal information as soon as possible. If you are a parent or guardian of a minor, please contact us using the contact information in this policy when you have questions about the handling of personal information about a minor in your custody.

9. Disclaimer

9.1 You understand and acknowledge that in the course of using the Service, you may encounter risk factors, such as force majeure, which may interrupt the Service. Force majeure refers to objective events that cannot be foreseen, overcome and avoided and that have a significant impact on one or both parties, including, but not limited to, natural disasters such as floods, earthquakes, epidemics of infectious diseases and storms, as well as social events such as wars, turmoils, governmental actions, and so on. In the event of any of the above circumstances, the Shipfinder Platform will endeavor to cooperate with the relevant units in the first instance to repair the situation in a timely manner, however, the Shipfinder Platform and the cooperating units shall be exempted from liability for any damages caused to the Users or third parties as a result of such damages to the extent permitted by law.

9.2 You understand and acknowledge that there is a risk that the Service will be interrupted or fail to meet the User's requirements due to force majeure, computer viruses or hacker attacks, system instability, the User's location, the User's shutdown, and any other technological, interconnecting internet, or communication line reasons, and that the Shipfinder Platform shall not be liable for any losses incurred by the User or third parties as a result thereof.

9.3 You understand and acknowledge that the Shipfinder Platform will need to overhaul or maintain the Shipfinder Platform or related equipment on a regular or occasional basis, and that the Shipfinder Platform shall not be liable for any interruption of the Services for a reasonable period of time due to such circumstances, provided that the Shipfinder Platform shall give prior notice thereof.

9.4 You understand and confirm that all information involved in the Shipfinder Platform services, including but not limited to vessel position, vessel track, vessel profile, container node dynamic information, blacklist sanction information, etc., are issued by the vessel's own AIS system or released by the shipping company, officially formulated, or procured from a third party, and that the Shipfinder Platform has processed and provided the data to the Users in an honest and truthful manner with due diligence. Shipfinder Platform has processed the data with due diligence and provided it to the users in a truthful manner. Shipfinder Platform has not made any changes to the data obtained and only presents the information in an objective manner. You understand and acknowledge that the data displayed on the Shipfinder Platform may have information limitations, incompleteness or time limitations, and that the Shipfinder Platform is not responsible for the truthfulness, applicability, or legality of any information sent or published, nor is it liable for damages caused to you as a result of infringement by a third party. At the same time, the Shipfinder Platform shall not be liable for any defects in the quality of the following products or services provided by the Shipfinder Platform to the users and any damages arising therefrom:

9.5 You understand and acknowledge that the Shipfinder Platform shall not be liable for any damages to Users or third parties resulting from the presence of any information from any other person, including misleading, deceptive, threatening, defamatory, offensive or unlawful information, or anonymous or impostor information infringing on the rights of another person, and the behavior that accompanies such information, in the course of using the Service.

9.6 You understand and confirm that if any information and content displayed or pushed to you by the Shipfinder Platform on its pages is suspected of infringing the intellectual property rights of any third party, the right holder and relevant interested parties shall send a notice of right to us, and we shall have the right to take measures in accordance with the relevant laws and regulations, including but not limited to disconnecting links to the infringing content or deleting and stopping transmission of the infringing content, after verifying the infringing content. If the infringing content is posted by other users, we shall not be legally responsible for the infringing content.

9.7 You understand and acknowledge that you agree to indemnify and hold us harmless from any claim, demand or loss, including reasonable attorneys' fees, asserted by any third party due to or arising out of your breach of this Agreement.

9.8 In no event shall the Shipfinder Platform be liable for any indirect, consequential, punitive, incidental, special or exemplary damages, including lost profits, suffered by the User as a result of the User's use of the Service (even if the Shipfinder Platform has been advised of the possibility of such damages). Notwithstanding any provision of this Agreement to the contrary, the entire liability of the Shipfinder Platform to the User, regardless of cause or course of conduct, shall at all times not exceed the fees, if any, paid by the User to the Shipfinder Platform for the use of the Services provided by the Shipfinder Platform.

10. Change, interruption or termination of services

10.1 In view of the special nature of the network services (including but not limited to force majeure, network stability, system stability, technical failures, your location, your shutdown, your cell phone viruses or malicious network attacks and any other technical, Internet, communication lines, content infringement, etc.), you agree that we have the right to interrupt or terminate part or all of the services at any time, and that we will try to notify you of the interruption or termination of the services as soon as possible in a timely manner and repair it as soon as possible in a reasonable manner. We will notify you in a timely and reasonable manner as possible, and repair it as soon as possible. However, we will not be responsible for your inability to send or receive reading information, or receiving or sending wrong information as a result of such interruption or termination, and you shall bear the above risks.

10.2 You understand that we will need to overhaul and maintain the platform or related equipment on which the Service is provided on a regular or occasional basis, and that we will give as much advance notice as possible, without being liable for any interruption of the Service for a reasonable period of time as a result of such circumstances.

10.3 If the personal information provided by you is untrue, or if you violate the laws and regulations, national policies or the rules of use set forth in this Agreement and other related agreements, we have the right to unilaterally interrupt or terminate the provision of the Service to you under this Agreement at any time without notice and without any liability to you or any third party.

10.4 You understand and agree that in the event of a merger, demerger, acquisition, or transfer of assets, Company may transfer the relevant assets under the Shipfinder Platform to a third party, and that Company may, upon unilateral notice to you, transfer some or all of the Services and the corresponding rights and obligations hereunder to a third party for operation or performance.

11. Other provisions

11.1 If you purchase the Shipfinder Platform Services in the form of a paper contract, order form or other paper document (collectively, the "Paper Contract"), you also acquire the status of a user of the Shipfinder Platform, enjoying the rights and fulfilling the obligations under this Agreement. Anything not covered by the Paper Contract shall be subject to this Agreement. If there is any conflict between the Paper Contract and this Agreement, the Paper Contract shall prevail.

11.2 If any provision set forth in this Agreement is for any reason partially or wholly invalid or unenforceable, the remaining provisions of this Agreement shall remain valid and binding.

11.3 In order to provide better services to Users or adjustments in national laws, regulations and policies, the Shipfinder Platform and related services will be updated and changed from time to time, and we will revise this Agreement in due course, and these revisions form part of this Agreement. When this Agreement is updated, we will issue an updated version on the Shipfinder Platform and make an announcement through the official Shipfinder website before the updated terms and conditions take effect, so that Users can keep abreast of the latest version of this Agreement, and Users can also check the home page of the website or the software settings page for the latest version of the terms and conditions of the Agreement. By continuing to use the Shipfinder Platform and related services, Users agree to accept the contents of the revised Agreement.

11.4 The copyright of this Agreement belongs to the Shipfinder Platform, and the final interpretation and modification of the terms and conditions of this Agreement belongs to the Shipfinder Platform.
